Restoring Net Neutrality Through Congressional Review Act Would Create Zombie Regulation

AAF’s Director of Innovation and Tech Policy Will Rinehart analyzes the likely results of reinstating the old Title II net neutrality regime through the Congressional Review Act (CRA). The Federal Communications Commission repealed the regime through a decision that could be considered both an adjudication and rule-making. Thus, only part of the old regime could be restored through a CRA process, creating a zombie regulation that is half-alive and half-dead.

Rinehart will speak on congressional efforts to restore net neutrality tomorrow on a panel hosted by the Competitive Enterprise Institute, titled “What Should Congress Do About Net Neutrality?”
